City of O'Neill Proceedings (7-16-2026)

A regular meeting of the Mayor and the City Council of O'Neill was held at the City Hall in said City on the 6th day of July, 2026 at 6:30 P.M.

Present: Mayor Scott Menish, City Clerk/Treasurer Sarah Sidak, City Attorney Boyd Strope and Council members; Kayla Burdick, Michelle Liewer, Paul Asche, Tim Schneider and Beth Walsh. Absent: Council President Quana Wheeler and Council members Chris Laursen and Tim Gleason.  

Notice of this meeting was given in advance thereof according to Section 84-1408 of the Revised Statutes of Nebraska. Notice of the meeting was given to the Mayor and all members of the Council and a copy of the acknowledgement of receipt of notice and the agenda is attached to the minutes. Availability of the agenda was communicated in the advance notice. All proceedings hereafter shown were taken while convened meeting was open to the attendance of the public.

The meeting was called to order by Mayor Scott Menish. The Pledge of Allegiance was recited. Mayor Menish informed the public of the location of the Open Meetings Act poster.

Moved by Schneider, second by Liewer to waive the reading of the minutes of the June 8th meeting and approve them as if read. Roll call vote as follows: All Ayes. Motion carried.

City Attorney Strope updated the Council on vacating Fairway Ave West of the intersection of Eagle Street and Fairway Ave. All the property owners are in favor of vacating the street. He will have more information at the August 3rd meeting.

City Attorney Strope read the second reading of Ordinance No. 1443 by title and number.  

ORDINANCE NO. 1443 

OF THE

CITY OF O'NEILL, 

NEBRASKA

AN ORDINANCE OF THE CITY OF O'NEILL, NEBRASKA, CONTINUING THE CITY'S ECONOMIC DEVELOPMENT PROGRAM, CONTINUING A SALES AND USE TAX OF ONE-HALF PERCENT (½%) TO BE APPROPRIATED TO THE ECONOMIC DEVELOPMENT PROGRAM; REPEALING PRIOR ORDINANCES IN CONFLICT HEREWITH AND PROVIDING FOR AN EFFECTIVE DATE.

BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF O'NEILL, NEBRASKA, that:

Sec. 1. On May 12, 2026 at the Primary Election, a majority of the qualified electors of the City voting at the election, passed the following propositions which were submitted on the ballot at the election:

A. The City of O'Neill shall continue its Economic Development Program by appropriating annually from local sources of revenue a one-half percent (½%) sales and use tax which will generate funds not to exceed 0.4 of the one percent of the City's valuation for 15 years.

B. The governing body of the City shall impose a sales and use tax of one-half percent (½%) upon the same transactions within the City of O'Neill on which the State of Nebraska is authorized to impose tax, with the proceeds of one-half percent (½%) being allocated to fund the O'Neill Economic Development Program beginning October 1, 2027 and ending of September 30, 2042.

Sec. 2. The City's Economic Development Plan previously adopted shall continue in full force and effect until September 30, 2042.

Sec. 3. Beginning October 1, 2027 and ending September 30, 2042 the City shall impose a sales and use tax of one-half percent (½%) upon the same transactions within the City on which the State of Nebraska is authorized to impose a tax, with the proceeds being allocated to fund the City's Economic Development Program.

Sec. 4. That all prior ordinances in conflict herewith are repealed as of the effective date of this Ordinance.

Sec. 5. That this ordinance shall be in full force and effect from and after its passage, approval, and publication as required by law.

RESOLUTION NO. 26-08

OF THE

CITY OF O'NEILL, 

NEBRASKA

BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF O'NEILL, NEBRASKA: 

Sec. 1. The Nebraska Legislature passed legislation that local governments are responsible for adopting regulatory requirements for swimming pools with their jurisdiction.

Sec. 2. Title 196 of the Nebraska Administrative Code-Environmental Health, Chapter 2 – Operation and Management of Swimming Pools, and as may be amended from time to time hereinafter, is hereby adopted for operation and management of the O'Neill Swimming Pool effective the date of passage of this Resolution.
