ORDINANCE NO. 1320

OF THE CITY OF O'NEILL, NEBRASKA

AN ORDINANCE OF THE CITY OF O'NEILL, NEBRASKA, ESTABLISHING SECTION 2-325 OF THE MUNICIPAL CODE REGARDING DOGS; REPEALING PRIOR ORDINANCES IN CONFLICT HEREWITH AND PROVIDING FOR AN EFFECTIVE DATE.

BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF O'NEILL, NEBRASKA, that:

Sec. 1. Section 2-325 of the O'Neill Municipal Code is hereby established to read as follows:

"SECTION 2-325 SPECIFIC BREEDS: ADDITIONAL REGULATIONS.

1. Any dog of the following breed:

a. Bull Terrier

b. Staffordshire Terrier

c. Staffordshire Bull Terrier

d. American Pit Bull Terrier

e. American Staffordshire Terrier

f. Any dog which has the appearance and characteristics of being predominantly of the breeds of bull terrier, Staffordshire bull terrier, Staffordshire terrier, American pit bull terrier, American Staffordshire terrier, or any other breed commonly known as pit bulls, pit bull dogs or pit bull terriers, or a combination of any of these breeds.

g. Rottweiler

h. Doberman

i. any wolf-hybrid, or

j. any dog crossed with any of the above named breeds,

are all hereinafter referred to as "Specific Breed" and are subject to the additional regulations in this ordinance.

2. While unattended on the owner's or caretaker's property, a Specific Breed dog shall be securely confined, in a humane manner, indoors, outdoors in an area bounded by a secure fence at least six (6) foot high with an inpenetrable base embedded into the ground and all gates locked, or outdoors in a securely enclosed and locked pen or structure suitably designed to prevent the entry of young children and to prevent the dog from escaping. The pen or structure shall have secure sides and a secure top or be six feet high. If the pen or structure has no bottom secured to the sides, the sides shall be embedded into the ground. The pen or structure shall also protect the dog from the elements. The owner or caretaker shall post a warning sign on the property where the dog is kept that is clearly visible and that informs persons to Beware of Dog.

3. No owner or caretaker of a Specific Breed dog shall permit the dog to be outside of the required secured enclosure or fencing unless the dog is restrained by a chain or leash of sufficient strength to control the dog and the dog is muzzled in such a manner as to prevent it from biting or injuring any person or animal.

4. Any Specific Breed dog may be immediately confiscated by an animal control officer if the owner or caretaker is in violation of this article. The owner or caretaker shall be responsible for the reasonable costs incurred by the animal control authority for the care of such a dog confiscated by an animal control officer or for the destruction of any such dog if the action by the animal control authority is pursuant to law and if the owner or caretaker violated this article.

In addition to any other penalty, a court may order the animal control authority to dispose of a Specific Breed dog in an expeditious and humane manner."

Sec. 2. That all prior ordinances in conflict herewith are repealed.

Sec. 3. That this ordinance shall be in full force and effect from and after its passage, approval, and publication as required by law.

OF THE 

CITY OF O'NEILL, 

NEBRASKA

AN ORDINANCE OF THE CITY OF O'NEILL, NEBRASKA, AMENDING SECTIONS 2-320 THROUGH 2-3322 OF THE MUNICIPAL CODE REGARDING DOGS; REPEALING PRIOR ORDINANCES IN CONFLICT HEREWITH AND PROVIDING FOR AN EFFECTIVE DATE.

BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF O'NEILL, NEBRASKA, that:

Sec. 1 Section 2-320 of the O'Neill Municipal Code is hereby amended to read as follows:

"SECTION 2-320 Dangerous Dogs: RESTRAINED.

No owner or caretaker of a dangerous dog shall permit the dog to be outside of the required secured enclosure or fencing unless the dog is restrained by a chain or leash of sufficient strength to control the dog and the dog is muzzled in such a manner as to prevent it from biting or injuring any person or animal."

Sec. 2. Section 2-321 of the O'Neill Municipal Code is hereby amended to read as follows:

"SECTION 2-321 DANGEROUS DOGS: CONFINED.

While unattended on the owner's or caretaker's property, a confined  dog shall be securely confined, in a humane manner, indoors, outdoors in an area bounded by a secure fence at least six (6) foot high with an inpenetrable base embedded into the ground and all gates locked, or outdoors in a securely enclosed and locked pen or structure suitably designed to prevent the entry of young children and to prevent the dog from escaping.
