A 34-year-old Stuart man appeared in Holt County District Court on July 29 for felony pornography charges.
Brian J. Raymer was charged with two counts of enticement by electronic communication, both Class 4 felonies.
District Court Judge Mark Kozisek sentenced the defendant to 60 days in Holt County Jail with credit for five days.
He also was sentenced to three years probation and is required to register under the Sex Offender Registration Act.
At the time of the offense the defendant was 34 and the victim was 13. Raymer has no prior sex offense convictions.
Raymer was fined $2,000 for the charges and also must pay $253 in other costs.
“His conviction stemmed from sexually explicit text messages he sent to a very young girl. I recommended that Mr. Raymer be sentenced to incarceration in prison. Although rehabilitation of the offender is important, I believe that it is also important to punish the offender and to deter the offender as well as others from committing a similar crime,” said Holt County Attorney Brent Kelly. “I would like to thank the victim and her family for their support and cooperation. The successful prosecution of Mr. Raymer was due in large part to their assistance and support.”
According to court documents, Raymer was arrested around 8:44 p.m. Sept. 13 at his residence and transported to the Holt County Jail for alleged third-degree sexual assault of a child, enticement by electronic device and visual depiction of sexually explicit conduct.
He later posted bond that was set at 10 percent of $200,000.
According to court records the Holt County Sheriff’s Office was notified by a 13-year-old female and her father that Raymer had allegedly been contacting her through text messages and Facebook messenger and was sending inappropriate pictures and messages as well as requesting naked pictures.
The minor female stated Raymer had known her and her family for several years.
