AN ORDINANCE OF THE CITY OF O’NEILL, NEBRASKA, AMENDING SECTION 1-313 OF THE O’NEILL MUNICIPAL CODE REGARDING THE TIME OF REGULAR MEETINGS; REPEALING PRIOR ORDINANCES IN CONFLICT HEREWITH AND PROVIDING FOR AN EFFECTIVE DATE.

BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF O’NEILL, NEBRASKA, that:

Sec. 1. That Section 1-313 of the O’Neill Municipal Code shall be amended as follows:

SECTION 1-313: MEETINGS; REGULAR; QUORUM

A. Regular meetings of the mayor and City Council shall be held on the first Monday of each month, except when the first Monday is the first day of the month, or the meeting day is a City observed holiday, then it will fall on the next Monday. All regular meetings will commence at the hour of 6:30 P.M. (Neb. Rev. Stat. §17-105, 17-106) (Am. by Ord. Nos. 548, 10/7/80; 621, 12/14/82; 673, 4/2/85; 1076, 11/17/97)

B. A majority of the members elected to the City Council shall constitute a quorum for the transaction of any business but a fewer number may adjourn from time to time and compel the attendance of absent members. Unless a greater vote is required by law, an affirmative vote of at least one-half of the elected members shall be required for the transaction of any business. (Neb. Rev. Stat. §17-105) (Ord. Sec. 2. That all prior ordinances in conflict herewith are repealed.

Sec. 3. That this ordinance shall be in full force and effect from and after its passage, approval, and publication as required by law.

The Board of Directors of the Upper Elkhorn Natural Resources District (“Board”) will hold a public hearing at 4:00 p.m. on August 23rd, 2021 at the Upper Elkhorn Natural Resources District office, 301 North Harrison Street, in O’Neill, Nebraska 68763. This is not a question-and-answer hearing. The purpose of this hearing is to receive testimony relevant to the adoption of proposed amendments to the District’s Rules and Regulations. A summary of the proposed amendments to the rules and regulations is as follows:

The proposed amendments apply to the overall Rules & Regulations.

The proposed amendments authorize a general restructuring of the number identification system of the Rules & Regulations.

Rule 2: The proposed amendments authorize updated enforcement rules and regulations to better conform to state statues.

Rule 4.6.9 The proposed amendments require the applicant for well permits to be in compliance with Upper Elkhorn NRD Rules and Regulations before approval.

Rule 4.10 The proposed amendments require flowmeters to be installed within one year after the date of approval to complete the well.

Rule 10.1.3.4 The proposed amendments require flowmeters to be installed and maintained indefinitely.

Rule 12.1.6 The proposed amendments require a flowmeter be installed on the legal description certified irrigated acres are transferred onto by October 1st.

Rule 12.1.8.8 The proposed amendments require the applicant(s)/landowner(s) transferring certified irrigated acres to be in compliance with Upper Elkhorn NRD Rules and Regulations before approval.

Rule 12.1.14.3 & Rule 13.5.2.3 The proposed amendments authorize a flat fee for expansion and transfer applications of $50.00 with additional fees for qualifying applications.

Rule 12.1.14.5 & Rule 13.5.2.5 The proposed amendments authorize in circumstances where property changes ownership expansion and transfer applications to be transferable from one landowner to another for the life of the expansion or transfer contract.

Rule 13.5.2.6 The proposed amendments authorize the Upper Elkhorn NRD to require the landowner to fulfill their expansion contract for a minimum of 5 years.

NOTICE TO BIDDERS

Sealed bids will be received by the Holt County Clerk until August 31, 2021 at 11:15 a.m. and opened shortly thereafter, for the construction of a concrete box culvert and other related incidental work. The project site is located on 478 Avenue between 853 Road and 854 Road in Holt County, Nebraska.

The project is referred to as “Amelia Southwest, C-45(539)” and shall include all labor, materials, transportation and equipment required for the construction of a twin 12’ x 8’ x 50’ Concrete Box Culvert on a 10 degree skew (RHB) with paved sloped inlet apron and paved outlet apron and concrete pavement and other related incidental work.

Copies of the Bid Documents and Specifications are open to public inspection at the office of the Holt County Highway Superintendent,1806 108th Road, O’Neill, Nebraska 68763. A set of documents may be obtained from Mainelli Wagner & Associates, Inc. for a non-refundable fee of $30.00. (6920 Van Dorn St., Lincoln, Nebraska 68506; PH: 402-421-1717). All Bid Proposals must be submitted on the forms furnished with the Bid Documents.

The sealed bids may be mailed or delivered to the County Clerk of Holt County, County Courthouse, 204 N. 4th Street, PO Box 329, O’Neill, Nebraska 68763, and should be plainly marked as, “Construction Bid Proposal – Amelia Southwest, C-45(539)”.

Along with its Bid Proposal, each bidder shall submit an unconditional Bid Bond or Certified Check made payable to the County Treasurer of Holt County, Nebraska, in an amount equal to five (5) percent of the Bid Proposal. Also, each bidder is to provide a Start of Construction date and an End of Construction date with its Bid Proposal. The desired completion date is July 15, 2022. The successful bidder (i.e. Contractor) will be allowed sixty (60) calendar days for after beginning work, provided they do not exceed their specified completion date. Additional days, due to poor weather conditions, may be granted at the discretion of the Engineer.

Within ten (10) days following the award of the Contract, the successful bidder shall furnish a surety bond or bonds in an amount equal to or greater than the full amount of the contract. The surety and form of the bonds are subject to the acceptance by the Holt County Board of Supervisors.

Holt County, in accordance with Title VI of the Civil Rights Act of 1964, 78 Stat. 252, 42 U.S.C. 2000d to 2000d-4 and Title 49, Code of Federal Regulations, Dept of Transportation, Subtitle A, Office of Secretary, Part 21, Nondiscrimination in Federally assisted programs of the Dept of Transportation issued pursuant to such Act, hereby notifies all bidden that it will affirmatively insure that in any contract entered into pursuant to this advertisement, minority business enterprises will be afforded full opportunity to submit bids in response to this invitation and will not be discriminated against on the grounds of race, color, or national origin, sex, age and disability/handicap in consideration for award.
