The Holt County Board of Supervisors met as a Board of Equalizations with all members present. County Assessor Tim Wallinger, County Treasurer Shelly Ross and County Clerk Cathy Pavel were also in attendance. This meeting publicized pursuant to Section 84-1411 R.R.S. 1943.  Notice of meeting given in advance thereof by publication in paper as shown by Affidavit of Publication on August 19, 2021, in the Holt County Independent and August 26, 2021, in the Atkinson Graphic.

Chairman Frahm convened the meeting at 9:00 A.M. with the flag salute.

Motion by Butterfield, 2nd by Paxton, to approve the minutes of the August 16, 2021, meeting as printed. Voting Aye: Keyes, Butterfield, Breiner, Paxton, Tielke, Treptow and Frahm. Voting Nay: None. Motion carried.

Chairman Frahm convened a public hearing at 9:01 to receive public comment on the Motor Vehicle Tax Exemption Applications submitted by: West Holt Memorial Hospital on a 2011 Nissan Sentra; Building Blocks for Community Enrichment on 2-2018 Chevrolet Malibu; St. Patrick’s Catholic Church on a 2019 Jeep Compass and a 2014 Suburban; Valley Hope Association on a 2019 Acura. No one appeared to comment.

Motion by Butterfield, 2nd by Paxton, to approve the tax list correction #21-033 as submitted by the Assessor. Voting Aye: Butterfield, Breiner, Paxton, Frahm, Treptow, Keyes and Tielke. Voting Nay: None. Motion carried.

Motion by Paxton, 2nd by Tielke, to adjourn from public hearing at 9:03 A.M. and return to regular session. Voting Aye: Breiner, Paxton, Tielke, Treptow, Keyes, Butterfield and Frahm.Voting Nay: None. Motion carried.

Chairman Tielke convened the meeting at 9:15 A.M. and informed the public of the location of the Open Meeting Poster.

Motion by Frahm, 2nd by Paxton, to approve the minutes of the August 16, 2021, meeting as printed. Voting Aye: Treptow, Keyes, Butterfield, Breiner, Paxton, Frahm, and Tielke. Voting Nay: None. Motion carried.

9:20 A.M. being the time advertised, time was allowed for public comment. Don DeGroff was present to speak during the public comment.

Motion by Keyes, 2nd by Paxton, to accept the agreement with Junior Young for the placement of the vending machine in the Courthouse. Voting Aye: Keyes, Butterfield, Breiner, Paxton, Frahm, Treptow and Tielke. Voting Nay: None. Motion carried.

Motion by Butterfield, 2nd by Breiner, to approve the surety bonds on file for: Kent Johring, Shields Twp Clerk; George Summers, Iowa Twp Clerk; Matthew Marcellus, Pleasant View Twp Clerk; Gregory J. The Board reviewed claims on file.

Natalie Butterfield and Pam Miller were present to discuss the placement of the General John O’Neill statute on the Courthouse lawn. Time was allowed to examine the proposed location of the statute.

Motion by Frahm, 2nd by Paxton, to allow the direct deposit payroll and other related claims. Voting Aye: Paxton, Frahm, Treptow, Keyes, Butterfield, Breiner and Tielke. Voting Nay: None. Motion carried.

Time was allowed for the Engineer to review the bid.

Motion by Paxton, 2nd by Butterfield, to approve the Right of Way permits for Niobrara Valley Electric for electrical cable for irrigation in Sections 5, 8, 9, 10, 11, 12-32-11and for Corey Pacha for livestock waterline in Section 32 & 33-29-15. Voting Aye: Keyes, Butterfield, Breiner, Paxton, Frahm, Treptow and Tielke. Voting Nay: None. Motion Carried.

RESOLUTION #2021-24

OF THE

HOLT COUNTY BOARD OF SUPERVISORS

For Emergency Relief Program-Emergency/Permanent Repairs

Project No. ER-45(31)

Control No. 81043

DDIR Site: L45-06

Whereas: Certain transportation facilities have been designated as being eligible for Federal assistance from the Department of Transportation through the Emergency Relief Program (ER) of the Federal Highway Administration (FHWA); and

Whereas: Major highways and bridges in Nebraska that are part of the Federal-Aid highway system suffered widespread serious damage as a result of flooding beginning on March 12, 2019 (Disaster #NE19) and were in need of emergency or temporary repair, or restoration; and

Whereas: The Nebraska Department of Transportation, as a recipient of the previously described Federal assistance, is charged with oversight of the expenditures of said funds; and

Whereas: The County has completed all repair work on an eligible Federal-Aid route to restore essential traffic.

Whereas: The project has met all contract provisions as required by 23 CFR Part 633A; met the Davis-Bacon wage requirements; and abided by the Disadvantaged Business Enterprises (DBE) requirements, American with Disability Act (ADA) requirements, “Buy America” Provisions, FHWA 1273 and prohibitions against the use of convict labor (23 U.S.C. 114); and

Whereas: The State has completed the required NEPA document, along with resource agency concurrences, and no new right of way (ROW) was needed for completing permanent repairs; and

Whereas: All emergency repairs were completed within 180 days and are eligible for 100% federal reimbursement; and

Whereas: All permanent repairs were completed following the flooding and are eligible for 80% Federal share reimbursement; and

Whereas: The total Emergency repairs reimbursement $20,067.00 and no further costs relating to this project will be incurred or submitted to the State.

Be It Resolved: That the Nebraska Department of Transportation is hereby requested to act on behalf of Holt County to administer Federal funds.

Be It Further Resolved: That the Chairman of the County Board is authorized to sign this Resolution on behalf of said Board.

The foregoing resolution was introduced by Supervisor Breiner, who moved its adoption. The motion was seconded by Supervisor Frahm. Voting Aye: Butterfield, Breiner, Paxton, Frahm, Treptow, Keyes and Tielke. Voting Nay: None. Motion carried.

1:00 P.M. being the time advertised, Chairman Tielke convened a public hearing at 1:05 P.M. and informed the public of the location of the Open Meeting Poster.

This public hearing is to receive public comment on the proposed 2021/2022 Budget. The proposed 2021/2022 budget documents were presented with an outline of the proposed budget and a comparison with the previous year’s budget. The proposed expenditures, property tax requirements and the budget message were presented.  No interested taxpayers were present.

The County tax rate is .332293 up from .318512 last fiscal year. This increase is due to the decrease in valuation.  

Chairman Tielke adjourned the budget hearing at 1:15 P.M.
