The Holt County Board of Supervisors met as a Board of Equalization with all members present except Tielke. County Assessor Tim Wallinger, County Treasurer Shelly Ross and County Clerk Cathy Pavel were also in attendance. This meeting publicized pursuant to Section 84-1411 R.R.S. 1943. Notice of meeting given in advance thereof by publication in paper as shown by Affidavit of Publication on July 29, 2021, in the Atkinson Graphic.

Chairman Frahm convened the meeting at 9:05 A.M. with the flag salute.

Motion by Paxton, 2nd by Butterfield, to approve the minutes of the July 30, 2021, meeting as printed. Voting Aye: Keyes, Butterfield, Breiner, Paxton, Treptow and Frahm. Voting Nay: None. Absent: Tielke. Motion carried.

Motion by Butterfield, 2nd by Paxton, to correct a 2021 value on parcel #450871000 due to clerical error. Voting Aye: Butterfield, Breiner, Paxton, Treptow, Keyes and Frahm. Voting Nay: None. Absent: Tielke. Motion carried.

Supervisor Tielke arrived at 9:08 A.M. 

The Board discussed levy authority for fiscal year 2021/2022 for the political subdivisions.

Motion by Paxton, 2nd by Breiner, to share levy authority of $.05 with the townships, $.05 with the fire districts and $.01 with the Holt County Agriculture Society, for 2021/2022. Voting Aye: Breiner, Paxton, Tielke, Treptow, Keyes, Butterfield and Frahm. Voting Nay: None. Motion carried.

10:30 A.M. being the time advertised, Chairman Tielke convened a public hearing to hear and consider public response to consider the vacation or abandonment of the following described public road: South line Sections 28 & 29 & W ½ SW ¼ 27-26-13. 5 interested landowners were present.  

Motion by Frahm, 2nd by Paxton, to adjourn from public hearing at 10:38 A.M. and return to regular session. Voting Aye: Frahm, Treptow, Keyes, Butterfield, Breiner, Paxton and Tielke. Voting Nay: None. Motion carried.

 

 

RESOLUTION #2021-22

OF THE

HOLT COUNTY BOARD OF SUPERVISORS

WHEREAS, the Holt County Board has received a request for vacation or abandonment of a public road of the County and whereas the County Highway Superintendent has conducted a study of the use of said pubic road and submitted his recommendation as to the vacation or abandonment to the County Board, and

WHEREAS, notice has been given as required by law and a public hearing held upon said vacation or abandonment, and 

WHEREAS, notice as required by law has been given to the Township offering to relinquish said road to the township.

NOW, THEREFORE BE IT RESOLVED BY THE CHAIRMAN AND THE HOLT COUNTY BOARD OF SUPERVISORS, that:

• The following described public road: South line Sections 28 & 29 & W ½ SW ¼ 27, Township 26 North, Range 13 West of the 6th P.M., Holt County, Nebraska.

• That the appropriate County Officials shall record this resolution upon the public records of Holt County as required by law.

 

 

The foregoing resolution was introduced by Supervisor Frahm, who moved its adoption. The motion was seconded by Supervisor Butterfield. Voting Aye: Treptow, Keyes, Butterfield, Breiner, Paxton, Frahm and Tielke. Voting Nay: None. Motion carried.

Dan Hanlon was present to discuss the traffic speed on 868 Road from 501 to 504 Avenue.

The Board acknowledged the updated list of trees and shrubs infringing on township roads in Emmet Township.

Motion by Frahm, 2nd by Keyes, to set a hearing on September 16, 2021, at 2:00 P.M. to consider if the landowner or agent is maintaining a public nuisance by failing to trim hedge fence, trees or undergrowth in accordance with statute 39-1812 & 39-1813. Voting Aye: Keyes, Butterfield, Breiner, Paxton, Frahm, Treptow and Tielke. Voting Nay: None. Motion carried

 

 

RESOLUTION #2021-23

OF THE

HOLT COUNTY BOARD OF SUPERVISORS

Project No. ER-45(31)   

Control No. 81043   

DDIR Site: L45-11

Whereas: Certain transportation facilities have been designated as being eligible for Federal assistance from the Department of Transportation through the Emergency Relief Program (ER) of the Federal Highway Administration (FHWA); and

Whereas: Major highways and bridges in Nebraska that are part of the Federal-Aid highway system suffered widespread serious damage as a result of flooding beginning on March 12, 2019 (Disaster #NE19) and were in need of emergency or temporary repair, or restoration; and

Whereas: The Nebraska Department of Transportation, as a recipient of the previously described Federal assistance, is charged with oversight of the expenditures of said funds; and

Whereas: The County has completed all repair work on an eligible Federal-Aid route to restore essential traffic.

Whereas: The project has met all contract provisions as required by 23 CFR Part 633A; met the Davis-Bacon wage requirements; and abided by the Disadvantaged Business Enterprises (DBE) requirements, American with Disability Act (ADA) requirements, “Buy America” Provisions, FHWA 1273 and prohibitions against the use of convict labor (23 U.S.C. 114); and

Whereas: The State has completed the required NEPA document, along with resource agency concurrences, and no new right of way (ROW) was needed for completing permanent repairs; and

Whereas: All emergency repairs were completed within 180 days and are eligible for 100% federal reimbursement; and

Whereas: All permanent repairs were completed following the flooding and are eligible for 80% Federal share reimbursement; and

Whereas: The total permanent repairs reimbursement is $35,963.82 and no further costs relating to this project will be incurred or submitted to the State.

Be It Resolved: That the Nebraska Department of Transportation is hereby requested to act on behalf of Holt County to administer Federal funds.

Be It Further Resolved: That the Chairman of the County Board is authorized to sign this Resolution on behalf of said Board.

 

 

The foregoing resolution was introduced by Supervisor Paxton, who moved its adoption. The motion was seconded by Supervisor Keyes. Voting Aye: Butterfield, Breiner, Paxton, Frahm, Treptow, Keyes and Tielke. Voting Nay: None. Motion carried.

Motion by Paxton, 2nd by Frahm, to approve the change order on the bridge rehabilitition project C004520510 for a decrease of -$2,425.20. Voting Aye: Breiner, Paxton, Frahm, Treptow, Keyes, Butterfield and Tielke. Voting Nay: None. Motion carried.

Motion by Paxton, 2nd by Breiner, to approve the Right of Way Permits on file for Village of Stuart for natural gas line in 22-29-11 & for Viaero Fiber Networks, LLC for fiber optic cable in Sections 20, 21, 27 & 28-29-11. Voting Aye: Paxton, Frahm, Treptow, Keyes, Butterfield, Breiner and Tielke. Voting Nay: None. Motion carried.

Gary Connot Road Superintendent presented his Department Activity Report.

The 2021/2022 Budget Hearing for Holt County will be held at 1:00 P.M. on August 31, 2021, at the conclusion of the regular Board of Supervisors meeting.

Motion by Frahm, 2nd by Paxton, to submit for public hearing on September 16, 2021, at 1:00 P.M. the final tax request at a different amount than the prior year tax request and adopt the proposed 2021/2022 County Budget. Voting Aye: Frahm, Treptow, Keyes, Butterfield, Breiner, Paxton and Tielke. Voting Nay: None. Motion carried.

The Finance Committee reported that the County Officials had remitted their monthly fees to the County Treasurer as required.
