The Holt County Board of Supervisors met as a Board of Equalization with all members present. County Assessor Tim Wallinger, Deputy County Treasurer Cathy Fuhrer and County Clerk Cathy Pavel were also in attendance. This meeting publicized pursuant to Section 84-1411 R.R.S. 1943. RESOLUTION #2021-25

OF THE

HOLT COUNTY BOARD OF SUPERVISORS

WHEREAS, the Holt County Treasurer has presented to the Holt County Board of Supervisors, a list of parcels of real estate on which taxes are delinquent 2019 and prior, and

WHEREAS, it is deemed proper that tax certificates are necessary on certain parcels of real estate,

NOW, THEREFORE, BE IT RESOLVED, that the Holt County Board of Supervisors hereby authorizes the Holt County Treasurer to write the necessary tax certificates on these parcels of real estate which are now delinquent two or more years.

RESOLUTION #2021-26

OF THE

HOLT COUNTY BOARD OF SUPERVISORS

WHEREAS, the County of Holt, Nebraska, is the owner of several Certificates of Tax sale on several parcels of real estate issued to the County of Holt for all delinquent regular taxes thereon, which have been regularly advertised and offered for sale at tax sale and, remaining unsold for want of bidders, were sold to the County of Holt and Certificates of Tax Sale issued thereunder the provisions of Nebraska Revised Statutes, Section 77-1809 (Reissue 1990); and

WHEREAS, more than two (2) years and less than five (5) years have elapsed since the issuance of such respective Certificates of Tax Sale and by reason thereof, the right for redemption of the owners or claimants of such respective tracts has expired.

NOW THEREFORE, BE IT RESOLVED that the County Attorney of Holt County, Nebraska, be and hereby is directed as promptly under the circumstances as it is reasonably possible so to do, to institute action to foreclose the lien of all taxes delinquent whether regular or special, on all real estate within Holt County, Nebraska, which having been heretofore advertised and offered for sale and remaining unsold for want of bidders was sold to the County of Holt, and further, said County Attorney can proceed to foreclose the Certificate of Tax Sale issued; and 

BE IT FURTHER RESOLVED that the County Attorney of Holt County, Nebraska, be and hereby is directed as promptly under the circumstances as it is reasonably possible so to do, to institute action to foreclose the lien of all taxes delinquent whether regular or special, on all real estate within Holt County, Nebraska, which having been heretofore advertised and offered for sale and remaining unsold for want of bidders was sold to the County of Holt, and further, said County Attorney can proceed to foreclose the lien of all taxes delinquent.

Motion by Butterfield, 2nd by Frahm, to increase the monthly Holt County Annex cleaning contract with Darla Smith to $1500.00 per month effective with her September 2021 claim. Voting Aye: Paxton, Frahm, Treptow, Keyes, Butterfield, Breiner and Tielke. Voting Nay: None. Motion carried.

The Finance Committee reported that the County Officials had remitted their monthly fees to the County Treasurer as required.

Motion by Butterfield, 2nd by Frahm, to approve the surety bonds on file for: Jeffery Mudloff, Verdigris Township Clerk; Harold Klinger, Sheridan Township Clerk; Joel Coburn, Saratoga Township Treasurer; Mark Cooper, Orchard Rural Fire Department; Gary Strong, Shamrock Township Clerk. Voting Aye: Frahm, Treptow, Keyes, Butterfield, Breiner, Paxton and Tielke. Voting Nay: None. Motion carried.

Sheriff Ben Matchett presented the Distress Warrant Report.

Motion by Butterfield, 2nd by Breiner, pursuant to Nebraska State Statute #77-1738 the Holt County Treasurer presented a list of Personal Property Taxes to the Board asking for approval to strike parcel #450000275 for $30.52, parcel #010000027 for $227.62 and parcel #010002664 for $147.40 from the tax roll due to no property in Holt County to levy on. Voting Aye: Keyes, Butterfield, Breiner, Paxton, Frahm, Treptow and Tielke. Voting Nay: None. Motion carried.

Motion by Paxton, 2nd by Frahm, to approve the change order on the Naper South Bridge Removal C004521725 the total project cost will decreased by $38,514.17. Voting Aye: Butterfield, Breiner, Paxton, Frahm, Treptow, Keyes and Tielke. Voting Nay: None. Motion carried.

Chairman Tielke reconvened the meeting at 1:00 P.M. with all members present.

1:00 P.M. being the time advertised, Chairman Tielke convened a public hearing to receive public comment on the proposed change of the tax levy from the prior year, as per published notice. No one appeared to comment.

Motion by Keyes, 2nd by Paxton, to adjourn from the Public Tax Request Hearing to change the levy from the prior year and return to regular session. Voting Aye: Keyes, Butterfield, Breiner, Paxton, Frahm, Treptow and Tielke. Voting Nay: None. Motion carried.

RESOLUTION #2021-27

OF THE

HOLT COUNTY BOARD OF SUPERVISORS

WHEREAS, a proposed County Budget for the Fiscal Year July 1, 2021, to June 30, 2022, prepared by the Budget Making Authority, was transmitted to the County Board on the 31st day of July 2021.

NOW THEREFORE, BE IT RESOLVED, by the Board of Supervisors of Holt County, Nebraska as follows;

SECTION 1. That the budget for the Fiscal Year July 1, 2021, to June 30, 2022, as categorically evidenced by the Budget Document and the Budget Message be, and the same hereby is, adopted as the Budget of Holt County for said fiscal year.

SECTION 2. That the offices, departments, activities and institutions herein named are hereby authorized to expend the amounts herein appropriated to them during the fiscal year beginning July 1, 2021 and ending June 30, 2022.

SECTION 3. That the income necessary to finance the appropriations made and expenditures authorized shall be provided out of the unencumbered cash balance in each fund, revenues other than taxation to be collected during the fiscal year in each fund, and tax levy requirements for each fund.

SECTION 4. The Holt County Board of Supervisors approve exceeding the restricted funds authority for the fiscal year 2021-2022 by an additional 1%.

RESOLUTION #2021-28

OF THE

HOLT COUNTY BOARD OF SUPERVISORS

WHEREAS, Nebraska Revised Statute 77-1601.2 provides that the property tax request for the prior year shall be the property tax request for the current year for purposes of the levy set by the County Board of Equalization unless the Governing Body of the County of Holt passes by a majority vote a resolution setting the tax request at a different amount; and

WHEREAS, a special public hearing was held as required by law to hear consider comments concerning the property tax request; and

WHEREAS, it is in the best interest of the County of Holt, that the property tax request for the current year be a different amount than the property tax request for the prior year.

NOW, THEREFORE, the Governing Body of the County of Holt, by a majority vote, resolves that;

1. The 2021-2022 property tax request be set at $9,550,000.00.

2. A copy of this resolution be certified and forwarded to the State Auditor on or before October 15, 2021.

OF THE

HOLT COUNTY BOARD OF SUPERVISORS

SIGNING OF THE COUNTY ANNUAL CERTIFICATION OF PROGRAM COMPLIANCE FORM 2020

Whereas: State of Nebraska Statutes, sections 39-2115, 39-2119, 39-2120, 39-2121 and 39-2510(2), requires an annual certification of program compliance to the Nebraska Board of Public Roads Classifications and Standards; and 

Whereas: State of Nebraska Statute, section 39-2120 also requires that the annual certification of program compliance by each county shall be signed by the County Board Chairperson and shall include a copy of a resolution of the governing body of the county authorizing the signing of the certification form.

Be it resolved that the County Board Chairperson of Holt County is hereby authorized to sign the attached County Annual Certification of Program Compliance form.

2:00 P.M. being the time advertised, a Public Hearing was convened to hear comments from the landowners that had received written notice from the County Attorney requiring them to have the weeds and undergrowth trimmed that were declared a public nuisance by the Rock Falls Township Board. 19 people were present. Motion by Frahm, 2nd by Paxton, to adjourn from public hearing at 4:11 P.M. and return to regular session. Voting Aye: Frahm, Treptow, Keyes, Butterfield, Breiner, Paxton and Tielke. Voting Nay: None. Motion carried.

Chairman Tielke adjourned the meeting at 4:15 P.M. until September 30, 2021, at 9:45 A.M.
