Holt County Court News

Several sentencings occurred on Jan. 1, Feb. 6 and Feb. 9 in the Holt County Court. Judge Kale B. Burdick presided.

Wilbur R. Cortez-Hernandez, 19, of O’Neill pled guilty to minor in possession, a Class 3 misdemeanor. The defendant was sentenced to two days in Holt County Jail. He also was ordered to pay $50 in court costs and fines.

Natasha C. Parks, 23, of O’Neill was charged with assault by mutual consent, a Class 2 misdemeanor. The defendant was sentenced to one day in jail and ordered to pay $50 in court costs.

Kasino A. Moore, 35, of Omaha pled no contest and was charged with three counts of issuing a bad check $0-$500, a Class 2 misdemeanor; issuing a check $500-$1,500 with no account, a Class 1 misdemeanor; and reckless driving-first offense, a Class 3 misdemeanor. The defendant is to stand committed to the Holt County Jail until he pays the $1,000 in fines and $250 in court costs. Moore is currently incarcerated at the Omaha Correction Center on charges of violation of probation for theft. 

Anthony J. Harvey, 23, of O’Neill was charged with DUI-.08 breath-second offense, a Class W misdemeanor. The defendant was sentenced to 10 days in jail and 12 months probation. Harvey had his driver’s license revoked for 18 months and was ordered not to drive for 45 days and an ignition interlock permit. Harvey also was ordered to pay $913.50 for sheriff fees,, probation fees and other fees. 

John W. Anson, 40, of Page was charged with DUI-.15+ or refusal-one prior conviction, a Class 1 misdemeanor, and driving during revocation/impound-first offense, a Class 2 misdemeanor. The defendant was sentenced to 30 days in jail with credit for 30 days served and 18 months probation. Anson had his driver’s license revoked for 18 months and was ordered an ignition interlock permit.  Anson also was ordered to pay $1,215 in court and lab costs as well as $570 in probation and drug testing fees.

Feb. 9

Jacob W. Humphrey, Tilden, waived his preliminary hearing and was bound over to district court on charges of aiding and abetting, a Class 2A felony, HCS Inv. Binkerd

Martin L. Hoffman, Merrill, Iowa, speeding, fined $25, HCS Inv. Binkerd

Robert A. Cullen Jr., waived his preliminary hearing and was bound over to district court on charges of delivering/disposing/distributing/manufacturing/possession of exceptionally hazardous drugs, a Class II felony, OPD Officer Jensen

Sydney M. Abbott, O’Neill, resisting arrest-first offense, 12 months probation, and two counts of possession or use of drug parahernalia, 24 months probation, OPD Officer Jensen

Lavern Lyle White Jr., O’Neill, violating a no passing zone, fined $25, NSP Trooper Viterna

Robert Henry Nathan Layton, O’Neill, waived his preliminary hearing and was bound over to district court on charges of failing to deliver title on sale and failure to pay sales tax.
