A 20-year-old Atkinson man appeared in Holt County District on June 26 for felony pornography charges.
Donald L. Shaffer was charged with enticement by electronic communication, a Class 4 felony, and criminal attempt of production of visual depiction of sexually explicit conduct, a Class 2 felony.
Holt County District Court Judge Mark Kozisek sentenced the defendant to five years probation with credit for 337 days served in Holt County Jail.
“The policy of my office is to seek prison time in any case involving a child victim. Although I asked for prison time, I acknowledge that Mr. Shaffer had served almost a year in jail prior to his sentencing, and that he is entitled to credit for that time under Nebraska law. We see and prosecute an alarming number of cases like Mr. Shaffer’s and will continue to try to put a stop to this type of predatory sexual behavior in Holt County,” said Holt County Attorney Brent Kelly.
According to court documents Sgt. Mike Parks of the Holt County Sheriff’s Office receive a report from a mother that a male party was harassing her daughters, ages 12 and 17.
The mother allegedly asked Shaffer to leave her kids alone, but he would not.
According to court documents Shaffer allegedly sent pornographic images and videos to the 12-year-old victim and also asked for illicit photos and videos.
Shaffer was arrested on July 24, 2018. His bond was set at 10 percent of $150,000.
